Who is responsible

The controller is MotionInk, registered in the Dominican Republic, a custom software studio. For anything about this policy, write to hello@motionink.ai.

What we collect

We do not ask for sensitive data and do not knowingly collect data from minors.

• What you write in the contact form: your name, your email, the kind of service you are interested in (optional) and your message.
• If you email us directly, your address and what you tell us.
• Your IP address when you send the form, only to limit abusive sending. We do not keep it in a database or in files: it lives for a few minutes in the server's temporary memory.
• As on any site, the hosting provider records technical data about the visit (such as the IP address and the browser) in its security logs.
• If we ever measure how the site is used, and only if you agree, data about that use (pages viewed, device, where the visit came from). Today we measure nothing (see the cookie policy).

What we use it for, and on what basis

We do not sell your data, do not use it for third-party advertising, do not add you to mailing lists and do not make automated decisions about you.

• To answer your message and, if you are interested, prepare a proposal. The basis is your free, express and informed consent, which you give by ticking the box in the form and of which we keep a record; and dealing with your request before a possible relationship.
• To send you an email confirming that we received your message.
• To protect the form and the site from abuse and automated sending: a legitimate interest of ours and of the people who write to us.
• If we turn measurement on, to understand how the site is used so we can improve it: only with your consent, which you can give or withdraw at any time.

Where it is kept

Messages from the form and the emails you send us arrive in our company email (Google Workspace) and are kept there: that is our database of contacts. We do not copy them into other databases. Only the people at MotionInk who answer the messages have access to it.

Who we share it with

We use providers that process data on our behalf, under contract and with security measures, without using it for their own purposes:

• Amazon Web Services: hosts the site and sends the form's emails.
• Google: Google Workspace receives and keeps our email. Google Tag Manager is installed on the site and, if it ever loads measurement tools, will do so only with your consent.
• Cloudflare: manages the domain (DNS). It does not receive the content of your messages.

International transfers

Those providers process data outside the Dominican Republic, in particular in the United States, with the contractual and security safeguards of their services. Ley 172-13 allows that transfer with your consent or when it is necessary to deal with your request: by ticking the box in the form you consent to it, and without it we could not reply to you.

How long we keep it

• Your message and our replies: for as long as we need to deal with you and, if we work together, for the length of the relationship and the periods the law requires (tax and commercial). If there is no relationship, we delete them after 24 months.
• Your cookie choice: 12 months, after which we ask again.

Your rights

You can ask us at any time for access to your data, for it to be rectified or updated, for it to be cancelled (deleted), and object to its processing; and withdraw a consent you gave, without affecting what was done before. These are the rights recognised by Ley 172-13 and the habeas data action of the Dominican Constitution (article 70) and, if you are in the European Union, the General Data Protection Regulation, which adds restriction and portability.

To exercise them, write to hello@motionink.ai from the address you contacted us with; if needed, we will ask you to confirm your identity. It is free. We will answer without delay and in any case within the periods the law sets. If you are not satisfied, you can bring a habeas data action before the courts or, in the European Union, complain to your data protection authority.

Security

The site is served over HTTPS, access to messages is limited to the people who answer them, and we use providers with recognised security controls. We keep your data confidential. If an incident that could affect you ever happened, we would tell you without delay.

Our clients' data in their projects

When we build or maintain software that handles data about a client's users, the client is responsible for that data and we act as its processor: we handle it only on the client's instructions and for the project, with confidentiality and security measures, and when we finish we return or delete it. The conditions of service and each project's contract set this out.

Minors

The site is not aimed at people under 18. If you think a minor has written to us, let us know and we will delete the message.

Changes to this policy

If we change anything important, we will update this page and its date and, if needed, ask for your consent again. You can ask us for earlier versions.
